1. Acceptance of Terms

By creating an account on profile.rocks, you agree to these terms. profile.rocks has the right to suspend any account or profile that violates these rules. Check the privacy policy for more information about how your data is handled.

2. User Responsibilities

Users are responsible for the content they publish on their profiles. Users must not publish content that is illegal, offensive, or violates the rights of others. profile.rocks is not directed at anyone under the age of 16.

3. Prohibited Content and Conduct

You may not use profile.rocks for any illegal purposes. Prohibited content includes, but is not limited to:

• Abuse: Cruelty, exploitation, or promotion of harm against people or other living beings.
• Age restricted content: Including, but not limited to, pornography.
• Confusing links: Links that are intentionally confusing, misleading, or fraudulent.
• Scam or fraud: Deceiving users for financial gain.
• Harassment: Targeted insults or hate speech.
• Illegal goods or services: Sale of drugs, weapons, or regulated items without permits.
• Impersonation: Falsely claiming to be another person or entity.
• Intellectual property infringement: Posting content you do not own or have rights to.
• Misinformation: Spreading false or misleading information that could cause harm or confusion.
• Phishing: Attempting to steal user credentials or data.
• Self-harm: Content that encourages or promotes self-injury or suicide.
• Violent content: Promoting violence or graphic depictions of harm.

A profile containing this type of content, or linking to it, may be reported (with a notification sent to the profile maintainers for possible correction) or even deleted outright, depending on the severity. In the latter case, a prior notification detailing the reason will be provided, along with the right to respond where applicable.

A user can only report the same profile once.

In cases profile.rocks deems severe (including, but not limited to, abuse of the reporting system) the platform reserves the right to temporarily suspend a user from using the platform (including account suspension), identified by credentials such as their email address. The user will be notified and will have the right to appeal.

4. Platform Role and Liability

profile.rocks provides a technical tool for creating profiles. The platform is not responsible for user-generated content and users are responsible for compliance with local laws.

If you use your profile for business (e.g., as a lawyer, or shop), you are responsible for linking your own Legal Notice and complying with local consumer laws. profile.rocks is not liable for your failure to provide these disclosures.

This website, profile.rocks platform and user profiles may display links to external websites, whose privacy practicesprofile.rocks is not responsible for. As mentioned in the "Prohibited Content and Conduct" section, a profile that contains prohibited content or links to it may be reported or even deleted.

The platform has the right to add, modify or remove features at any time, including themes and the user interface of profiles.

profile.rocks reserves the right to permanently discontinue or shut down the service at its sole discretion. In the event of a planned permanent shutdown, profile.rocks will provide all registered users with at least 20 days advance notice. Users are responsible for exporting any personal data or content within this 20-day window. After closing the service, all profiles and user data will be deleted from profile.rocks systems.

Data is stored and managed using Microsoft Azure's cloud infrastructure, which includes backup and redundancy features. However, in the event of a natural disaster or other force majeure event beyond reasonable control, no liability will be held for data loss or service unavailability.

In the event of a significant data loss, the following measures will be taken:

• Reasonable backup and recovery measures are maintained at all times.
• Affected users and the relevant supervisory authority will be notified.

5. Payments and premium services

Polar.sh will be used as a Merchant of Records for premium subscriptions and payments. By purchasing on profile.rocks, you may also agree to their terms and privacy policy. Refunds are handled according to their policy: https://polar.sh/docs/features/refunds.

profile.rocks has the right to add, modify and remove premium features, prices and plans; with at least 30 days' notice if the changes are material or affect the price. Everything is listed in the pricing page.

If a premium profile uses premium features, but the subscription is cancelled, the profile will be downgraded to a free profile, the premium features will be removed, and the default settings of the free profile will be applied. For example, a premium profile uses a premium theme; after switching to a free profile, the default theme of the free profile will be used.

profile.rocks reserves the right to set and update the default settings for free profiles.

If a premium profile is deleted, the payment order cannot be refunded unless it is within Polar.sh's refund period (i.e., it was recently paid).

6. Modifications to Terms

profile.rocks reserves the right to modify these Terms at any time. If a revision is material, profile.rocks will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at profile.rocks's sole discretion. By continuing to access or useprofile.rocks's Service after those revisions become effective, you agree to be bound by the revised terms.
